Official Rules & Regulations

Rotary Club of Santa Barbara Sunrise Charitable Foundation is a non-profit organization under 501(c)(3) of the Internal Revenue Code and registered with the State of California. 

  1. All dolphins entered will be provided by the Presenter and remain the property of the Presenter. Rotary Club of Santa Barbara Sunrise Charitable Foundation warrants that all holders of dolphin adoption papers (or receipts from online entries) have an equal chance of winning with each entry. The Rotary Club of Santa Barbara Sunrise Charitable Foundation as “Presenter” will provide a maximum of 3000 toy dolphins for the Dolphin Dive Drawing. Winning dolphins will be selected in Chase Palm Park, 236 East Cabrillo Blvd., Santa Barbara, CA at approximately 3 PM on Saturday, July 6, 2019. 

  2. The IRS has taken the position that amounts paid for chances in raffles, sweepstakes, lotteries or similar drawings for valuable prizes are not gifts, and consequently, do not qualify as deductible charitable contributions

  3.  Dolphin adoptions (entries) must be delivered to the Rotary Club of Santa Barbara Sunrise Charitable Foundation at least 1 hour prior to the start of the dolphin drawing if submitted in person, or through the Text-To-Give platform to be eligible to win any prize. Mail entries must be received at Santa Barbara Sunrise Charitable Foundation, PO Box 50355, Santa Barbara, CA 93150 by Friday, July 5, 2019. 

  4. If all dolphins are not adopted in advance the day of drawing the winners, dolphins will be available for adoption during the Dolphin Dive event site during the day of the Dolphin Dive. No adoptions will be accepted within 30 minutes of the drawing.

  5.  Online adoptions are encouraged so that we can provide an immediate confirmation of receipt of an adoption acknowledgment. 

  6. The Presenter reserves the right to limit the number of dolphin adoptions per individual.

  7. A $ 10 donation enters a dolphin into the dolphin race drawing (Checks should be written to: “Rotary Club of Santa Barbara Sunrise Charitable Foundation”). Text donations (entries) can be made by texting “dolphin” to 805-920-8139.  No purchase is necessary to enter.  Entries without donation should be sent to Santa Barbara Sunrise Charitable Foundation, PO Box 50355, Santa Barbara, CA 93150 by Friday, July 5, 2019. 

  8. All dolphins are the property of the Rotary Club of Santa Barbara Sunrise Charitable Foundation for the purpose of the raffle drawing. Adoption of a dolphin is simply an assignment of a name to a dolphin (or multiple dolphins) for the period of the raffle drawing. All dolphins entered will be provided by the Presenter and shall remain the property of the Presenter.

  9. Anyone 18 years of age or older and a U.S. resident physically residing in the United States may enter the drawing. All federal, state and local laws and regulations apply. The raffle is void where prohibited or restricted by law. An affidavit of eligibility may be required from prize-winners.

  10. While the toy dolphins are released down a water course, the winning dolphin may be selected randomly from a sampling of dolphins at the end of the course, rather than being a certified "winner" of the race. The decision of the contest judges in the fair selection of the winning dolphins is final.

  11. Winning dolphin numbers and the related adopting persons’ names will be announced through-out the event.  The Grand Prize ($ 5000) winner will be announced at approximately 3:30 PM.  Cash prize winners will be posted on our website www.sbdolphindive.com within 24 hours following the winner selection.

  12. Winners need not be present to win. Rotary Club of Santa Barbara Sunrise Charitable Foundation will attempt to contact winners by telephone, email, and mailing address. If a winner cannot be contacted with a reasonable effort and does not come forward to claim their prize within 30 days of the dolphin drawing the prize will be forfeited.

  13. All prizes will be awarded as stated. No substitutions will be allowed. Any taxes, if applicable, will be the responsibility of the prize-winner.

  14. Rotary Club of Santa Barbara Sunrise Charitable Foundation warrants that all holders of dolphin adoption papers (or receipts from online entries) have an equal chance of winning with each entry.

  15. Odds of winning with 3000 entries: 
    a.    odds of winning any cash prize are 1:1000
    b.    odds of winning the Grand Prize are 1: 3000 

  16. A winner of the $ 5,000 prize must submit a "copy of a government-issued ID card containing a photo of the claimed winner and a completed and signed IRS form W-9".

  17. No more than 3,000 dolphins will be entered in the dolphin drawing by the Santa Barbara Sunrise Rotary Club as "Presenter".  

  18. The dolphin drawing method will be established by the Presenter and Presenter reserves the right to manually move or handle dolphins in order to prepare the dolphins in a location for drawing. The Presenter reserves the right to conduct the dolphin drawing in an alternative location and/or format or at a different time/place should circumstances require based on the sole judgment of the Presenter. Any change in venue or time will be announced publicly.

  19. The order of prize selection may be changed by the Presenter at its sole discretion, as long as the prize associated with each dolphin drawing is clearly stated prior to its selection.  Multiple races will be conducted throughout the day, for different prizes.  If a dolphin has won a prize, it will be removed from the dolphin selection pool for future races.  The proposed order for dolphin selection will be as follows: a. In-kind prize winners will be selected prior to selection of the cash prize winners. b. Two separate dolphin races will be run to selected two $ 1,000 prize winnersThe Grand Prize $ 5,000 dolphin will be selected d. Alternate dolphins will be selected and added - in order of selection - to a list of alternate winners that will replace a winner that fails to claim their prize within 30 days of the announcement of winners. 

  20. Assigned dolphin numbers will be clearly marked on each dolphin but may be coded. Dolphins entered through donations intended to adopt multiple dolphins from an adoption paper or the www.sbdolphindive.com website or the text2give platform will be assigned individual numbers for identification. The person that corresponds to the number of the dolphin selected in each drawing will be named and awarded the respective prize by Presenter. Positive identification and signed IRS form W-9 will be required to claim any prize won.

  21. Presenter reserves the right to substitute prizes of comparable value. Prizes may be subject to change prior to the drawing, however, the combined value of all prizes will equal or exceed $ 7,500.

  22. Prize winners will be announced following each dolphin race. Entrants will be notified by United States mail, email, or by telephone provided on the adoption form or website. Dolphin Dive drawing winners need not be present to win. If any prize-winner does not claim his or her prize from the Presenter at the address listed in paragraph eight (8) above within 30 days after June 24, 2018, the Presenter will select the alternate winners in order from the alternate winners list.

  23. By entering, entrants release the Presenter and its officers, directors, members, staff and other related entities from any and all liability with respect to prizes, the Dolphin Dive promotion, the Dolphin Dive drawing, and the festival.

  24. All decisions regarding the Dolphin Dive raffle or interpretation of the rules will be made by Presenter and its judgment is final.
